Judges say they cannot preside in Va. Tech lawsuit

BLACKSBURG, Va. (AP) - The circuit judges in Montgomery County say they cannot preside over the civil lawsuit filed by families of 2 slain students in the Virginia Tech mass shootings.

The lawsuits on behalf of Julia Pryde and Erin Peterson are seeking $10 million in damages

According to a court order earlier this week, the judges recused themselves, only saying there was a conflict in hearing the case. The order says Judge Colin R. Gibb will handle any matters in the case until the state Supreme Court names a replacement. It did not say how many judges are in the circuit.

The families are suing the state, Virginia Tech, and several university and mental health officials. Also named is the estate of Seung-Hui Cho (sung-wee joh), the student gunman who killed 32 people before taking his own life in 2007.
