A Charles City County Animal Control Officer will not face any charges after the King William County Commonwealth's Attorney Office declines prosecution.
On Nov. 1, 2012, Officer Frank Bates responded to the 14000 block of The Glebe Lane after receiving a complaint of an aggressive canine. The complainant stated that her 17 year-old son was pursued by the canine after getting off the bus that afternoon. As Bates arrived at the complaints residence to investigate, he was confronted by the aggressive canine.
As Bates attempted to get the dog to leave the complainants residence, he turned away from the canine to continue his investigation when the canine came at the officer in an aggressive manner. Bates, in order to protect himself while in the performance of his duties, shot the canine once. The canine died at the scene.
State Police was contacted by the Charles City County Sheriff's Office to investigate the shooting. After conducting the investigation and interviewing independent witnesses, state police contacted the Charles City County Commonwealth's Attorney Office who requested that the King William County Commonwealth's Attorney be appointed as a special prosecutor to review the case.
The state police investigation was turned over to the King William County Commonwealth's Attorney for a prospective review where prosecution was declined.
