RICHMOND, Va. (AP) - Attorney General Ken Cuccinelli has again said legislation authorizing Medicaid expansion is unconstitutional.
And in a separate opinion released Friday, Cuccinelli reached the same conclusion about a regional component of the sweeping transportation funding bill passed by the General Assembly last month. The opinions were requested by Republican Del. Bob Marshall of Prince William County, who opposed both plans.
Last month, Cuccinelli said a bill creating a panel to oversee reforms required to expand Medicaid was an unconstitutional delegation of legislative authority. Lawmakers revised the bill to take away the panel's discretion and passed it, but Cuccinelli says it still doesn't pass constitutional muster.
Cuccinelli also says certain tax increases in northern Virginia and Hampton Roads for to pay for regional transportation projects are unconstitutional.
