Webb to Stay in Henrico Jail

RICHMOND, VA - Convicted hit-and-run driver Elias Webb will remain in a Henrico County jail after a Richmond judge ruled she does not have the authority to order his transfer.

Webb had been moved from the Richmond City Jail to a Henrico County jail where he could receive treatment for sleep apnea. Richmond and Henrico sheriff's officials say is not unusual for inmates to change facilities so they may receive treatment for medical needs.

Prosecutors argue Webb is not properly serving out his sentence, as he's serving time in a Henrico County jail and not the Richmond City Jail, an overcrowded, un-air-conditioned facility.

Judge Margaret Spencer ruled Wednesday that she does not have the power under state law to order Webb to a specific jail.

Elias Webb was sentenced to three years behind bars after being found guilty of felony hit-and-run in the July 2012 wreck left 24-year-old Lanie Kruszewski dead.

Webb's attorney says Webb is only being held in Henrico due to his medical conditions and that he is being afforded the same treatment as any other inmate with his circumstances.
