RICHMOND, Va. (WRIC) - On Monday, a judge decided to charge the teenager accused of murdering Martin “Marty” Cobb, the 8-year-old boy who was killed last month while reportedly trying to protect his older sister from being assaulted, as an adult.

The 16-year-old suspect Mairese Washington has been charged with Second Degree Murder. The judge said there was not enough evidence to show premeditation. Washington is also charged with strangulation and malicious wounding against the 12-year-old sister.

Former prosecutor and now defense attorney Alex Taylor isn't affiliated with this case, but he has an idea of why prosecutors initially brought the tougher more serious first degree murder charge.

"I'm confident the fact that we are dealing with such a young little boy that was killed had some play in the decision to go with the charges," he says. "But if the judge doesn't find it was premeditated, then the charge doesn't go to circuit court for premeditation." 

"The young people are victims and their families are victims as well because everyone is impacted in both sides of the aisle. In a lot of those cases, there are no winners."

According to family members, Marty and his sister were playing near some railroad tracks in their backyard on the 200 block of Brandon Road on the evening of Thursday, May 1 when a man walking on the tracks sexually assaulted the girl and cut her face. Marty tried to intervene, but was killed instantly when the suspect threw a rock at his head. The girl was hospitalized following the incident, but survived the alleged attack. Richmond Police detectives identified and located Washington within hours of the crime.
