Final Person Charged in Rusty Mack Death on Trial

COLONIAL HEIGHTS, Va. (WRIC) -

A jury composed of five men and eight women was selected Wednesday in the trial of Margaret "Blair" Dacey. Dacey is the last of four people originally charged in the beating death of Colonial Heights man Rusty Mack.

Dacey is charged with murder and felony assault. She was underage at the time of Mack's death but is being tried as an adult on these charges. She is the fourth and final person to head to court in the case; the other three people charged in the case, Francis "Frankie" Blaha, Jonathan  Guy and Ashley Mack, have all walked free.

Rusty Mack, 21, was brutally beaten to death in February 2013. 

Four witnesses took the stand for the prosecution; one of them was Rusty's ex-wife, who gave new details about what she says happened the day of the attack.

Ashley Mack testified that Rusty Mack was obviously drunk on the night of the incident. She said Rusty got in her face and she pushed him away. She said she didn't see how he ended up on the ground, but later that night Dacey began bragging and said "I kicked that [explicative] in the head."

On cross examination, Ashley admitted that her first police report was not completely true and admitted she lied. The defense used this to try and question her credibility.

Three other witnesses also testified: a police officer, an eye witness who says he saw Blair kick Rusty, and a soccer teammate of Dacey's who said Dacey had received special training to be a stronger kicker. 

Court resumes Thursday at 9 a.m.; Dacey's jury trial is scheduled to last three days. 

Mack died weeks after police say he was beaten outside his apartment by four people, including his estranged wife, Ashley Mack.
