Could father be charged in toddler’s hot car death?

HENRICO COUNTY, Va. (WRIC) — A devastated family continues to grieve as investigators piece together the tragic death of a 17-month-old child. 

The child died Wednesday after his father left him inside of the family SUV for hours. 

Prosecutors must now decide if the father of 17-month-old Riaan Gondesi created a criminal act or if it was simply an accident that led to a devastating tragedy.

Legal analyst Russ Stone believes it will probably be a couple of days before the Commonwealth’s Attorney decides whether the father should face consequences.

“Whether or not there was anything bad in the father’s behavior that might have caused him to forget what was going on or if it was just the normal zoning out that frankly, everybody goes through from time to time,” Stone said. 

Stone says charges could range from involuntary manslaughter to contributing to the delinquency of a minor, or if it was truly an accident, the punishment for the father might just be living with what happened. 

“The criminal justice system can’t fix everything and sometimes a horrible tragedy is just a horrible tragedy,” Stone told 8News. 

8News reached out to the family, who politely said they are not ready to talk about what happened.
